Check N’ Play – Terms & Conditions

Welcome to Check N’ Play! These Terms & Conditions (“Terms,” “Agreement”) govern your access to and use of checknplay.com, online ordering and reservation systems, membership tools, events booking, and all related digital services (collectively, the “Services”). The Services are operated by Check N’ Play (“Check N’ Play,” “we,” “our,” or “us”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. USE OF THE SERVICES
Eligibility
You must be at least 18 years old to use the Services. Parents or legal guardians may use the Services on behalf of children for booking, reservations, and events.
Play Space Eligibility, Age Guidelines & Supervision
The play space is intentionally designed for children age six (6) and under. The layout, materials, equipment, and play structures are developmentally appropriate for this age range and are not scaled or modified for older children.
During regular open play sessions, facilitated play sessions, classes, camps, and shared-access events, participation in the play space is strictly limited to children age six (6) and under. Children older than six (6) are not permitted during these times.
An exception may apply during The Dot Affair birthday package, Full Facility Buyouts, and select special events, or other designated all-ages events. During these events, older children may participate as permitted by Check N’ Play and under the supervision and responsibility of their parent, caregiver, or booking party.
Even during these exceptions, the play space remains specifically designed for children age six (6) and under. Participation by older children is permitted only as designated by Check N’ Play and remains subject to applicable safety rules and restrictions. Check N’ Play reserves the right to restrict access to any play elements or activities if safety concerns arise.
Children twelve (12) months and under may attend free only when accompanying a paying sibling. If no sibling admission is purchased, an infant play ticket must be purchased.
Check N' Play is not a licensed childcare facility. Parents or legal guardians of children who are not fully potty trained must remain on the premises at all times, either in the café or play space. Play Attendants support engagement and safety but do not provide childcare services.
Account Registration
If you create an account:
- You agree to provide accurate and complete information.
- You are responsible for maintaining the confidentiality of your login credentials.
- You agree to notify us immediately of unauthorized account use.
We reserve the right to suspend or terminate accounts for violations of these Terms or misuse of the Services.
2. RESERVATIONS, MEMBERSHIPS & EVENTS
Play Sessions, Classes & Event Bookings
- General Policy — All Ticket Types
All play session ticket sales and reservations are final and non-refundable. This policy applies to all ticket types, ticket variations, and associated add-ons offered by Check N’ Play. Reservations may be canceled or rescheduled at least 24 hours prior to the scheduled session start time for account credit, subject to availability. No monetary refunds will be issued. Cancellations made less than 24 hours before the scheduled start time, as well as no-shows, late arrivals, unused time, and voluntary early departures, are not eligible for a refund, account credit, or rescheduling. - Facilitated Play & Structured Programs
Facilitated Play sessions and other structured programs require advance staffing, preparation, and capacity planning. All tickets are final and non-refundable. Eligible reservations may be canceled or rescheduled for account credit when at least 24 hours’ notice is provided, unless otherwise stated at the time of booking. - Events, Classes, Parties, Camps & Special Programs
Ticketed events, classes, birthday parties, private bookings, camps, character meet-and-greets, and other special programs may have separate cancellation, rescheduling, and account credit policies, which will be disclosed at the time of booking. Due to staffing, preparation, customization, capacity limitations, or third-party costs, certain bookings may be non-refundable and ineligible for account credit or rescheduling, or may be subject to different deadlines and terms. - Discretionary Exceptions
Check N’ Play reserves the right, at its sole discretion, to make exceptions and issue an account credit, refund, or permit rescheduling in extenuating circumstances. Any exception granted on one occasion does not modify the applicable policy or create an entitlement to an exception for future bookings.
Memberships
Membership terms (billing frequency, renewal, usage limits, termination, suspensions) will be made available during checkout. By purchasing a membership, you agree to the terms applicable to your plan.
3. ONLINE ORDERS & PAYMENTS
Pricing & Availability
All prices displayed through the Services are subject to change and may differ from in-store prices. Product availability is not guaranteed.
Payments
We use third-party payment processors. By submitting payment information, you authorize us and our payment processor to process your transaction.
We do not store full credit card information.
Order Errors
If an error occurs in pricing, product availability, or order processing, we may:
- Cancel the order
- Correct the error and request confirmation
- Issue a refund
4. ACCEPTABLE USE POLICY
You agree not to:
- Use the Services for illegal, fraudulent, or unauthorized purposes
- Attempt to access systems or data without permission
- Scrape, crawl, or collect data from the Services through automated tools
- Interfere with the operation or performance of the Services
- Upload viruses, malware, harmful code, or attempt to disrupt security
We may suspend access for violations of this policy.
5. INTELLECTUAL PROPERTY
All content available on the Services—including text, images, logos, videos, graphics, icons, design elements, and software—is owned by or licensed to Check N’ Play and protected under applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, display, or create derivative works from such content without our express written permission.
6. USER CONTENT
If you submit reviews, comments, photos, messages, or any other content (“User Content”), you grant Check N’ Play a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute the content for business purposes (e.g., marketing, testimonials).
You represent that:
- You own or have the right to submit the User Content
- Your content does not violate any rights of third parties
- Your content does not contain harmful, offensive, or illegal material
We may remove User Content at our discretion.
7. WAIVER OF LIABILITY & ASSUMPTION OF RISK
By participating in play sessions, classes, events, or activities at Check N’ Play, you acknowledge and agree:
- Physical activity and play involve inherent risks, including potential injury.
- You voluntarily assume all risks associated with participation.
- You release Check N’ Play, its owners, employees, contractors, and agents from liability for injuries or damages except where prohibited by law.
Parents or legal guardians accept full responsibility for the safety and conduct of their children unless participating in a designated supervised-care program.
This waiver applies to all activities conducted at or through Check N’ Play unless a separate written waiver overrides or supplements these terms.
8. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the Services are provided “as is” and “as available” without warranties of any kind, whether express or implied.
We do not guarantee that:
- the Services will be uninterrupted or error-free
- information provided is accurate, complete, or up-to-date
- defects will be corrected
- the Services are free from harmful components
9. LIMITATION OF LIABILITY
To the fullest extent permitted by law:
- Check N’ Play will not be liable for indirect, incidental, punitive, or consequential damages arising from your use of the Services or participation in activities at our facilities.
- Our total liability for any claim related to the Services will not exceed the amount paid by you for the specific transaction or $100, whichever is less.
Some jurisdictions do not allow the limitation of liability; some limitations may not apply to you.
10. INDEMNIFICATION
You agree to indemnify and hold harmless Check N’ Play, its owners, officers, employees, and contractors from any claims, damages, losses, liabilities, and expenses arising out of:
- Your use or misuse of the Services
- Your participation in activities at our facilities
- Your violation of these Terms
- Your violation of any rights of another person
11. PRIVACY POLICY
Your use of the Services is also governed by our Privacy Policy, available at:
checknplay.com/privacy
(or at the location where it will be published)
The Privacy Policy explains how we collect, use, and protect your information.
12. THIRD-PARTY LINKS & SERVICES
The Services may contain links to third-party websites or service providers. We are not responsible for:
- the content
- privacy practices
- terms
- security
of any third-party websites or services.
Your interactions with third parties are at your own risk.
13. MODIFICATIONS TO THE SERVICES OR TERMS
We may modify or discontinue the Services at any time without notice.
We may also update these Terms. When we do, we will update the “Last Updated” date at the top of this page.
Your continued use of the Services after updates constitutes acceptance of the new Terms.
14. TERMINATION
We may suspend or terminate your access to the Services at our discretion if we believe you have violated:
- these Terms
- our policies
- applicable laws
Upon termination, your right to use the Services immediately ends.
15. GOVERNING LAW; DISPUTE RESOLUTION
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Dispute Resolution
Except where prohibited, disputes will be resolved through:
- Good-faith negotiations, then
- Binding arbitration in Orange County, CA, administered by a recognized arbitration provider
You agree to waive the right to a jury trial and class action participation to the extent permitted by law.
